He "missed" them - says the unnamed accusers.
TN law (written by lawyers turned politician) for the crime of aggravated assault says you don't have to actually "assault" someone - your accuser just has to say that you "tried" to assault them.
Did he have a gun? No.
Did he hit you? No.
Did he physically harm you or touch you in any way? No. But he was in a car and that's a deadly weapon.
So, he hit you with a car? No. But, I'm pretty sure he meant to. I was afraid.
Okay, let's arrest him for aggravated assault.
Prediction:
Charges will eventually be reduced because he'll agree to pay off the accusers and the Courthouse Cartel (judges, lawyers, bail bondsmen, corrupt politicians) will also get their share of the profits.
And so it goes.
EDIT
OK, so I really don't know who is Sara Evans other than she is apparently a musician married to Jay Barker.
And it wasn't clear from first story posted that she was one of the accusers - just said "unnamed" accusers.
I still think a felony is kind of a ridiculous charge given that nobody was actually injured or even touched.
