| FTBL Stabler found "Not Guilty" on DUI charge...

Altie I am so sorry that you have lost someone to drunk driving. It effects many families. My son has had several DUI's and is working his way back to society after loosing two great careers because of it.

I live in Fairhope AL, and know more than I should. Kenny was stopped when a Robertsdale Al policeman that is now a State Trooper saw him pass by. This person is an Auburn Fan. Robertsdale has a bad rap about giving out tickets. This policeman stopped him and claimed that he smelled Alcohol. There was none in his Vehicle, and Any Attorney will tell you not to blow, because the science is not foolproof.

They did not do a good job of the evidence. They have stopped a lot of folks in this area for no good reason. Robertsdale is a speed trap. No other police department in other local towns are this way.

Also Many of the local Judges refused the case because of where it originated and a lot of them were on boards with Kenny, or had associations with him.

Who knows if he was guilty or not.

My two cents :?

I spent lots of time thinking about it over the years, RollllTide!, lots of time and at different times in my life depending on when the tragedies occurred.

Have I used alcohol and driven a vehicle. Yes, I have. Have a received a DUI? No, I haven't. Does that make me a better person than someone who has? Not really, it just makes me different.

How many on this board, in our neighborhoods, at our churches, working for us or with us, how many of our friends, etc... have ever drank alcohol at some instant or point in time in their lives and drove a vehicle?

I would say 99% of them have. From the times as a worry free teenager out having the times of your lives with friends to the times you are at a local bar with business associates and have a beer and drive home 30 minutes later, and on and on and on.

Rewind back 20-25-30 years ago and beyond when drinking and driving was as normal as apple pie at your grandmother's house and cops or anyone else never blinked an eye if you were drinking and driving. Lots and lots and lots of the people who criticize and besmirch the character of drunk drivers are hypocrites. Not a nice word, but the truth.

Should we drink and drive? No way. Do I drink and drive? No way. I haven't since I was in my early 20's. But, am I somehow able to judge others and look down on them with haughty indifference as if I am some pristine and self-righteous being who stands above them? No. I have done the same thing they have done.

That is what judges in a court of law are for. When I know someone has drove while intoxicated, I try to talk to them when they are sober. I try to get through to them and make them see how wrong and dangerous it is and how it can rip families asunder and how that type of thing affects whole generations of families.

Good luck to your son, btw. I wish him nothing but the best.

And there you go RollllTide! None of us know what exactly happened, how it happened or anything else.

There is a very high probability that it happened just as you say and everyone knew it and that is why Kenny S. is a free man today.

For the cop that pulled him over and if it happened like you say it did, which I don't doubt, I would have not taken a breath test either.

Just out of principle I would not take a breath test. If I haven't been drinking, which I don't drink at all, not even beer, and a cop tried to force me to take a breath test, I would be really pissed.

Where there is smoke there is fire. I too have been guilty of drinking and driving. I have never been DUI. I am one that will stop before I get to far. I always let someone else drive if I have had too much. I have called a taxi when my car was fine and my friends were too drunk to drive me. 40 Years ago we could drink and drive without it being a crime. It didn't make it safer or OK. There was a lot less vehicles on the road. The wheels stayed in the ruts.

I met the President of MAAD on a plane ride from Dallas to Houston and was very impressed with her agenda. I had a drink on the seat next to her and listened to what she had to say about the Beer and Alcohol industry. She was not against drinking but against making a drink the cool thing to do for young people. She lost a son to a drunk driver. Her organization changed the way Alcohol is advertised and I believe it has made a difference. She influenced me a lot on that 45 minute ride. I support them to this day.

I Don;t know if Snake was drinking or not. I have heard from a policeman I know from Foley AL (Kenny's hometown) that it was a setup. He is also an Auburn Fan.

The only truth that I know is when you try to argue with a fool it is hard to tell who the fool is. I do not believe we will ever know the truth. Snake is lucky.

Sticking up for this guy is a joke, you should be ashamed of yourselves. This was his third time, and he wasn't convicted.
So it wasnt his third time? Right?

There's only one reason why a person refuses a breathalyzer. Hey, maybe one day he'll take out a family member and on gameday you can brag about it at the tailgate.
Stop it. I hate people that drink and drive. My point was you have no idea what happened.

Gotta call BS on this...You claim to know more than you should    You know nothing...in fact the only thing you said that was accurate was that the officer was a Auburn Fan. And you imply that is why Kenny was stopped   Kenny was stopped because he failed to yield to the emergency vehicle. I have known that officer personally for almost twenty years. He did not even know who Kenny was...and even after finding out..didnt give a flip one way or another. As for your MANY LOCAL JUDGES comment...another lie. Only two judges recused themselves...The sitting judge Brackin ( Who had dealings with some of Kennys past civil issues ) and Scroggins ( recused due to him representing one of the potential witnesses in a unrelated case )Those were the only judges involved besides Sweet...who heard the case. The sitting prosecutor had to recuse himself due to representing Kenny on a previous DUI. As for the evidence issue...the refusal was not admitted as evidence due to the officer stepping away from Kenney for about ten seconds to secure his sidearm in a lockbox...therefore bringing in the issue with not having Kenny under a full 20 minute observation period prior to the reading of implied consent. A technical mistake that the officer made...and the judge rightfully ruled not to allow the refusal into evidence. As for no alcohol in the vehicle...makes no difference. Watch the video...its obvious Kenny is trashed...take out all the legal mumbo jumbo and use some common sense....he was loaded. You can watch it at WKRG's web site. As for all you anti police garbage....sounds like you or somebody you know may have contributed to the local revenue. And your comment about the judges being on board with Kenny.... Give me a break...I would absolutely love to know who you are speaking of...since they ( whoever they are ) had no knowledge of the facts in the case. Jim Sweet IMO ruled correctly in the case..he had no choice given what was presented to him. As for the officer making the mistake that he did...he will learn from it and hopefully be more aware of that in the future. I try not to call somebody out like this...but you are way out of line in your statements which are just blatant lies.

Anti police? Im sure your friend is a great guy but the Robertsdale force and most Baldwin policemen have a reputation that was earned.

The ten second rule and the fact that you say the two judges excused themselves shows I am correct. Jim Sweet ruled correctly in the case? shows the 10 second rule is a loophole that only a rookie cop could get caught on.

Wouldn't the ten second rule be dismissed as a non issue if the Judge had viewed the video like you did? I am assuming you are referring to the video the local station from Mobile ran, I wonder who is zooming who? This same officer from Robertsdale that gets promoted to State patrolman that you know personally shows my last point exactly.

When you argue with a fool it is hard to tell who the fool is.

There is no such thing as Baldwin County Policemen. In no way did I bash the police. In fact my information came from a police officer.

Speed a little through Robertsdale and you will know what I am talking about. Try to go to their traffic court and you will know what justice is. The waiting for your turn before the judge is very long. I ended up paying a fine for running a light that was a caution light because the wait was over 4 hours. It was not worth it to fight city hall.
