🏈 Kirby on SEC Network Speech

Bret Bielema says Georgia head coach Kirby Smart asked for permission to talk to Arkansas offensive coordinator Dan Enos, but Bielema informed Smart that Enos has a non-compete clause in his contract regarding other SEC schools. Bielema said last January that all of his assistants hired after his first season at UA have the clause.

You can get around non-competes fairly easily though.

Would have to see the language, but I could probably find 1 or 2 ways around it.

I know Alabama is a right to work state, and essentially that a non-compete holds no water. I have signed several and gone on to work with others and had no issue. Did have one company send me a cease and desist letter, but that was as far as they went. I left them and went to another company and worked there for 15 years. Like any contract, they are about as useless as the paper they are written on if someone has the right lawyer and wants out.

When they usually do hold up, it when a company (or in this case the school) spends resources (time, money, etc.) training the person for the job. They can often prevent that person from using that training to work for a competitor.

However, many non-competes fail when the employee already possesses the skills/experience for the job. It is his/her livelihood and their access to means... a company cannot prevent a person from earning their living by saying they can't use a skill they already possessed.

Depending on the trade/position, the geographic limitations and time constraints come into play. That's another reason I'd have to look at the contract... but I ain't doing that for free just to help UGA....
