🏈 Bama Suing Daniel Moore?

I suspect that Mr. Moore's fame has made him the convenient Poster Child for Universities to use to redefine/reshape Copy Right/Image Right laws. With a couple dozen other schools issuing legal statements/briefs in support of the University's case, its not entirely about Daniel Moore. This case will establish precedents will be referenced for years to come, and across the nation.
 
There is no doubt that the painting historic Bama football moments has made Daniel Moore both wealthy and famous, but the U of A has benefitted considerably from Moore's work as well. The school continuing to go after Moore in this way leaves a bad taste in many people's mouths, including mine. I wish they'd drop the suit.
 
Not to be disloyal....but i've said much the same thing guys.
The only color more important in Tuscaloosa than Crimson or White
is GREEN. Blue Collar working class folks are being priced out ofthe stadium
in droves. The decistion to add all those sky boxes to the south endsone in stead
of luxurey chairback seating, which would have increased capacity considerably shows
that it's the all mighty dollar that Dr. Witt & Coach more care about more than the
average everyday fan.

I could see if these paintings were portaying the school/team in a negative light.
but thier NOT. Instead of sueing Mr. Moore they should be endorsing his work.
This is just wrong, classless, and in poor taste. In a time where i've never been more
proud to be a supporter & fan of UA.....this is just disapointing. I've yet to hear of 1
fan backing this lawsuit as of yet. and i doubt there will be very many fans @ all sideing
with the Univeristy on this one.

and how is this any differnt than what a pro photogropher does? (Doemaster wanna chime in here)
He's painting a historical event from his own perspective.
It's art. it's not.....
Sigh whatever i'm out of gas on this one. it's just bad.
 
Why can't the university make Moore their official "artist laureate" or something like that and gracefully stop trying to win this pi$$ing match. That way, whenever Moore paints an Alabama moment to offer for sale, the University would be part of the process and thus make his paintings "official" in a way. The contract could be written in a way that states the Moore would get the profits he deserves for his talents and the university would be able to make the legal precedent problem go away. Then those who infringe on university copyrights couldn't point at Moore and say "why can't I do it, he does?"
 
I have gotten my email from the University telling me that I am not allowed to sell any of my pictures because the sale of items depicting current University of Alabama student-athletes and the commercial distribution of items depicting current student-athletes, without their permission, is impermissible according to NCAA regulations and requires that this notice be issued. At one point I had the photo section setup so that people could buy prints at cost so no profit was made but since the email i have turned it off and had to email people letting them know to just download the pictures and get the printed anywhere they like. Thus the creation of my new domain FreeLancePictures.com
 
Not being an attorney, and without actually doing the home work to look it up....i'm of a mind to think that it has more to do with the contractual obligations to whatever lics. firm they signed on with and $$$ than anything else. I'm looking on @ on my desk here a pack of GUM. bout a buck 1/2 @ any store.
But it's Alabama Gum. i though it was a neat novelty (like coke bottles) so bought it. What is interesting about this packaging other than its UA theame?

The little OFFICIALLY LICENSED PRODUCT logo on the back ofthe package.

And that my freinds is the nuts and bolts of the lawsuit. They want to force Mr. Moore to offcialy license his art work, there by cuting the school and the licensing company in on the profits. And Mr. Moore doesen't want to do that. and you can't blame him 1 bit.
it's really a Henryetta the Hen Story, DM plowed the feild, planted the corn, grew the corn, picked the corn, shucked the corn, cooked the corn, & now they want to show up and help him enjoy eating the corn?

@ Doe, what's the worst they could do to you? If you were selling your photo's as a freelance sports photogropher to a news company, paper, magazine as a photo journalist....That's a violation of your constituinal rights to freedom of the press......i would think. How can they do that and get away with it?
 
I don't want to ruffle any feathers here, but I agree with U of A on this. If they're paintings of U of A, it's stadium, coaches, players, etc then why shouldn't the school get a bigger piece of the pie? All Mr. Moore has to do is sign the paper to officially license the paintings. I also understand the view from the all of you that are in support of Mr. Moore. It's a matter of greed from both sides, Mr. Moore doesn't want to sign the paper to officially license the paintings because then he has to share his wealth and U of A wants him to do it, so they can get a bigger piece of the pie. This is no different than those of you that own your own business and somebody uses your logo or something to put on a jacket, hat, notebook, etc you'd want to get money for the use of your logo, well U of A owns everything U of A and have done a great job marketing the product they have and deserve a sizable chunk of the pie.

The main thing is that i am taking pictures as a fan from my seats, i would understand more if i was on the sideline

Daniel Moore, in my opinion, has such an unmistakabley special history and mutually benefitial relationship with the University that I wonder if he could not be given some special status/affiliation with the UA that would resolve most of this. I understand that a coffee mug Mr. Moore sells may have a moment in Alabama history printed on it, but it is just as true that the mug has a copy the Daniel Moore print that hangs in my living room printed on it. It is neither soley Bama nor Daniel Moore.

thats what i was thinking as well but decided not to argue with them anyway, i wasn't making anything off of them anyway. I will let more parents complain to them again this year when they find out. One told me they never get any pictures of their daughter and they always come to our site here and get them. She said that some that she ordered of her daughter cost her like 20.00 a picture
