"THE Ohio State University", not just "The". And you can use it all you want, just can't sell apparel with that on there.

As one who has been involved in many trademark filings and unfortunately have been in court to protect them.. I think they can trade mark a logo or design with the word the but you cannot trademark the word “the”

I had a similar battle with a much less used word and while I could trademark my design the word was not allowed.

Just my 2 cents
