Update...49ers Reuben Foster talks about offseason court case (suspended 2 games)

We will never "really know" the true story... as in any dv situation like divorces, there are many variations of the truth. I remember the Taylor kid from UGA that got bounced, did his time in JUCO and then when Saban offered him, Saban got raspberries from everyone. Then the girlfriend yelled "he hit me" shortly after he enrolled at Bama. He got bounced from Bama and pretty much ended his possible career. A few months late, his "victim" also recanted and said she was just mad at him and knew this would get his attention.
Did she really lie? or did she just realize he had killed his career (and her potential future checks?) who will ever really know. Everyone is so quick to believe the victims stories and in many cases rightfully so. But, seems I remember from high school civics that there should be a presumption of guilt, no wait...maybe not guilt? well, big bad boys always wrong, and ... well, we will never really know. many will always think she was paid off and others that she was just mad or jealous.. maybe a little of both.


At least 2 courts of judgment facing Reuben and ballplayers these days. The legal court system and Roger Goodell. One doesn't always have much to do with the other.

Three... court of public opinion, which in some cases ends up mattering more.
 
It will dismissed or plead. It was found on a search warrant that was based on lies.
I can almost guarantee you it won’t be dismissed, but could see it plead. A gun charge in California is almost certainly never going to be dismissed.

I’m not sure how it works in CA, but here where I’m at if we find something on a search warrant we charge for it regardless then the lawyers do their thing.

My guess is the DA thought she was recanting because she saw her earnings potential going down the drain and the DA said nope afraid not there’s evidence, but didnt see the video of the fight? That part is odd
 
Reuben Foster girlfriend admits she lied about domestic violence

Former Alabama and current San Francisco 49ers linebacker Reuben Foster may be in a good position to avoid serious punishment after he was charged by the Santa Clara County District Attorney's Office on felony counts of domestic violence, forcefully attempting to prevent a victim from reporting a crime, and possession of an assault weapon after their investigation of a dispute involving Foster and his girlfriend on Feb. 11.

The attorney for Foster's girlfriend, whose name has not been released, told The Sacramento Bee that her client initially lied to police about how she obtained her injuries on the night in question.

“(Foster) did not strike her, injure her or threaten her,” Stephanie Rickard, the girlfriend's attorney, said. "She said Foster tried to end the relationship with her after learning of the fight. She was extremely upset and told him if he broke up with her she would ‘trash his career.’"

The 28-year-old woman was forced to go to the hospital with injures that included a ruptured eardrum. Foster was allegedly the cause of her ailments, however, Rickard said her client sustained the injuries in a fight with another woman. The attorney also told the Sacramento Bee that there is video of that confrontation between Foster's girlfriend and the unknown woman.

Rickard also indicated that Foster's girlfriend has informed local prosecutors of her updated story, but the district attorney's office still chose to file charges against the 49ers linebacker. Prosecutors allege that Foster punched his girlfriend eight to ten times during the dispute while also forcefully dragging her from the residence, causing bruising and a ruptured eardrum in the process. Officers responding to the incident also found a Sig Sauer 516 short-barreled rifle in the residence, which led to Foster being hit with an assault weapon charge. The former All-American was also charged with a misdemeanor count of possession of large capacity weapon magazine, but that claim was later dismissed.

Foster was a first-round pick last year after four seasons at Alabama. On April 14, Crimson Tide coach Nick Sabancommented on the case involving his former star player.

“We hate it very much when any player that we had here, who did a great job for us here at Alabama -- great job -- in terms of how he represented the university, how he represented our program, the contribution that he made to our program…” Saban said. “Obviously we have a player that you’ll probably ask me about that has legal issues: Reuben Foster. I don’t think I’m in a position to comment, because I don’t know the details and the facts."

Foster is currently not participating in 49ers team activities while his legal matters proceed. He stood out as a rookie with the 49ers last season, totaling 72 tackles in 10 games and performing at a level that made him one of the league's best defensive rookies when healthy.

San Francisco has stated that the organization will wait until Foster's case concludes to decide on his future with the team.
 
That sounds promising for Reuben. If we are just down to him and her in the eyes of the law this could have a happier ending than otherwise could have been. If this gets dropped he may not miss a game.

so he smashed a cell phone. is that actually a crime? i guess maybe...destruction of property? he can pay for a new one for her.

and the weapons? how are those illegal? i swear, every time i hear some news report about something...almost anything...there's a mention of guns being at the scene. is that illegal? why do they always have to say there was a gun at the scene? unless it was used in the commission of a crime, then the gun has NO bearing on anything to do with the case. and so what if they were loaded. guns that are unloaded are no good to anybody. mine stay loaded 24/7. the hell am i gonna do with an unloaded gun? throw it at somebody?
and in the news report, from the link posted above, it said, "...and a Sig Sauer short-barreled rifle" then it goes on to say, "Foster has been charged with felony possession of an assault weapon in relation to the Sig Sauer." i didn't know short-barreled rifles were considered assault weapons. if that's the case, then ANY weapon can be considered an assault weapon. hell, a pencil can be an assault weapon if used to assault somebody. the same goes for a car/truck, a garden hose, a spoon, a coffee mug, telephone cord, a stapler....ANYTHING!!!

man....the state of kommifornia is just.....hell i don't know what to call it. they love to use the terms assault weapon and assault rifle and apply it to anything they can. sorry for the rant. but sometimes crap like that against firearms/guns really gets me going. i am SO glad i don't live in that hell-hole of a state.

And most of all, the DA feels really compelled to share all this attention-grabbing stuff with the general public. I suspect they need to walk it around the block a few times to see if anyone really cares. The longer this goes, the less it feels like they got to make this stick.

Certain weapon types, and clip capacities, are illegal in California.
 
What I'm trying to figure out about that latest article is what is the point? Literally the only "new" evidence is the broken cell phones. My biggest issue with this whole thing is the video. Supposedly the DA is claiming he needs "more time" to review the video yet was told about its existence long ago. Not only that, she has attempted to recant her story several different times (especially after the video leaked on social media).

A quick synopsis is this, CA came up with an "assault weapons" bans several years ago and then proceeded to list any weapon capable of accepting a detachable magazine, including handguns. Anything over a 10 round magazine is illegal. It is really pathetic out there!!

I think the throwing her dog across the room may be new as well. To your point though, outside of the phone and dog, this has all been hashed out in public.
