šŸˆ UT football players arrested for armed robbery

is this a joke? If not that is a huge blow to Lame Kitten's program. I hate it for the kids but love it for UT Football!
why hate it for the kids???????they know right from wrong and ya we all make mistakes, but to do something that will get you in trouble(arrested)is just plain dumb and they deserve to be locked up and their college careers taken away and be given to some1 who deserves it!!

They'll plead and get probation.

If you take a city like Memphis, there is no such thing as a plea for armed robbery. The only thing that might differ from Knoxville to Memphis is the time. One lawyer from that area (Mphs) said the minimum is 7.5 years for this crime.

This isn't as simple as a drug case or something like that. There is no plea.

If you do the research you'll see this ranks up there with murder when it comes to time served.

There is no substance abuse program and probation for armed robbery. It's a big boy crime, and it doesn't matter if it's performed with a red tip cap pistol or a .40 Glock.

They should be thankful they didn't run across someone with a real gun and a strong desire to keep their belongings. It could have turned out much worse than it did.

If they are underage I am not sure if they will get big boy crime time.

This really doesn't surprise me coming out of UT. They got a coach that runs his ****washer all the time. Other coaches running around with their shirts off acting like immature teenagers. Lil Wayne or whatever blaring in their ears. Taking in a kid that held down his own cousin to rape. and then this crap with these 3 druggies that just got busted. I think the sole reason for the "victims" not wanting to file or press charges is perhaps they were the ones maybe bringing them some dope and they thought they'd rip them off. Pure specualtion and all... but given the evidence of the baggy, the time of the incident, the victims being from out of town and sounding like a couple of DA stoners, weed paraphenelia (sp?) in the Toyota car ....I wouldn't put it past them as this was all just a plan that feel completely back in their face.

I have zero pitty for crooks, theives and morons. Regardless of their age.

SIAP, I haven't read thru this thread.

Armed robbery will turn into Displaying A Weapon and they will get probation. Two 18 y/o kids.

18 year old or not, aggravated robbery along with a marijuana and drug paraphernalia charge isn't going to be dropped down to simply "brandishing a firearm" No way, no how.

They may plead down from the full sentence, but they'll both spend at least 12-18 months in a correctional facility.

It isn't aggravated, it's armed, big difference. Aggravated means a victim was caused physical harm. That didn't happen. They may do a little time but it will still be plead to a lesser charge. The girl will take the charge for the dope.

Argo,
Not trying to be a blowhard as I've only been in "The Profession" fo 30 years. It doesn't matter what they are charged with, it will matter what they plea to. What they did was not aggravated. They will get off with probation.

According to the Tennessee State Law which I linked, how is it not aggravated robbery?

It's in black and white. They pulled a weapon, and did so to commit robbery. According the laws of the State of Tennessee, it's aggravated robbery.

In Tennesse, just like Alabama, there is no "armed robbery" charge.

In Alabama, it's....

Robbery 1
Robbery 2
Robbery 3

In Tennessee, it's....

Especially Aggravated Robbery
Aggravated Robbery
Robbery

It's a class B Felony. Again, no way, no how, do they walk on probation. They will serve time, plead or not.

I do agree that it doesn't matter what they are charged with, and I agree that they will plea. It won't be to only probation. As I stated earlier, 12-18 months with probation.

Robbery in Tennessee

Tennessee Code Annotated Section 39-13-401 states: "Robbery is the intentional or knowing theft of property from the person of another by violence or putting the person in fear." Robbery is a Class C felony punishable by three to 15 years in prison and up to $10,000 in fines.
The word "intentional" is significant in robbery cases. Intentional refers to a person who acts deliberately to take property from another through fear or intimidation. "Knowing" on the other hand refers to a person who acts with knowledge that he or she is taking property from another through the use of fear or intimidation.
Aggravated and Especially Aggravated Robbery in Tennessee

Robbery can be elevated in two circumstances to "aggravated robbery" or "especially aggravated robbery." According to Tennessee law, aggravated robbery is:
  • Accomplished with a deadly weapon or by display of any article used or fashioned to lead the victim to reasonably believe it to be a deadly weapon; or
  • Where the victim suffers serious bodily injury (T.C.A. Section 39-13-402).
Aggravated robbery is a Class B felony, which carries stiffer penalties than a Class C felony.
Especially aggravated robbery is:
  • Accomplished with a deadly weapon; and
  • The victim suffers serious bodily injury (T.C.A. 39-13-403).
"Especially aggravated robbery" is a Class A felony, the most serious type of felony under Tennessee law. The key difference between "aggravated robbery" and "especially aggravated robbery" is that the first requires either the use of a deadly weapon or serious bodily injury whereas especially aggravated robbery involves both the use of a deadly weapon and serious bodily injury to the alleged victim.
