The test can tell how frequently and/or recently people have used marijuana. Experience. Didn't care because it didn't matter.

I'm with you. If a guy shows up positive for coke? Habitual, or very recent. I've seen highly functioning coke heads.

Background checks donā€™t show immigration status, law enforcement can see if thereā€™s an immigration hold, but business background checks donā€™t show that

IF I were to hire someone and pay them and they are illegal, I'd face prosecution/charges. Why aren't they?

Willfully and knowingly hiring somebody with that status would result in charges, but if it can be proven they didnā€™t know then you canā€™t file charges. A normal pre employment background check doesnā€™t show immigration status nor does it show ICE detainers

How would an employer not know the immigration status of an employee? A little thing called I-9?

If the Dr. lied on his I-9? There are four different consequences including civil, criminal, termination, and deportation.

In either case, "I didn't know" isn't a defense. Ignorance has never worked as a defense especially when it's contrived.
 
This is off the top of my head so I won't get the jargon right. It's been several years since I've read about violations.

In this case, I'm not talking about the doc. It's the school board / employer.

I remember three type of violations and two of them I thought were pretty close to each other. There's one considered a little mistake. It moves up a step when it comes to how the I-9 is completed. As I recall it's supposed to be completed and submitted within three days of the new hire date. A week? That's a violation: likely civil.

Then there's the last one which deals with not verifying eligibility. It deals with hiring unauthorized workers (like the Hyundai deal.) This is the big one and what they didn't do.


The curve ball for me is how they suspended him with pay and didn't immediately fire him. Suspended, means he's still employed, which is a direct violation of the law.

What I was thinking. Every job has asked if I'm legally allowed to work in the US. Pretty dumb if they're taking my word for it but maybe they'll just ask if I smoke if I have to apply again.

As an independent contractor you still have to fill out the I-9 to verification. I have. (There are a few exceptions but I don't think he's changing the sheets in some domicile.)

It appears he just lied an no one bothered to check and we're not talking about his immigration status alone. I've seen reports this morning from Morgan State: "he attended, but didn't finish." And that doctorate? MIT says they've never heard of him. George Washington has said this award he's claimed about being "Principle of the Year" doesn't even exist.

Sounds like the school board needs to be fired as well.

Yes, Iā€™m aware of the I-9. If somebody showed the proper paperwork, visa, ssn, etc then the employer wouldn't know any different. It would have to be proven that the school board in this case knew without a doubt that he was here illegally.

If the Dr lied then thatā€™s different than the school board knowing

That was a headline I saw this morning. I haven't been afforded the time to see how much of it was true. I can't recall the outlet; Google News feed on my phone where I have no preferences and little history. I can't see the author making up several quotes from those institutions.

I don't have any experience on the administrative side of HR. I know they make the copies, keep all of that one file, and are required to submit it within a time frame. I transposed two numbers and it was caught quite quickly; within 48 hours I believe.

Several chapters in this little story ... crazy one.

Criminal background checks donā€™t show immigration status. We have to search the database to see immigration holds/retainers, NCIC doesnā€™t show that, so school personnel could get one done weekly and it wouldnā€™t change cases like this

I-9's do. That's the point. Every new hire has one.

If it's a new annual contract, wouldn't it be a new I-9?

They put the info in and send it. If he gives them his Visa then they wouldnā€™t have any clue. I-9 doesnā€™t tell the employer if theyā€™re here illegally or not. The government informs them if thereā€™s an issue and the employer has to make changes. So, if the government notified the employer about his immigration status and they didnā€™t do anything then they should be held accountable

That's the way I see it. There is a notification.

My gut tells me the school board ignored it...the lawsuit against the background company, which isn't responsible in some areas, gives me that notion.

The lawsuit against the background company is stupid and will get tossed quickly because the background as I said wouldnā€™t show immigration status of any kind
